Charges for Simon Cuevas Case Suspects Downgraded to Assault

UPDATE: In a shocking turn of events, the charges against the four suspects in the tragic death of 14-year-old Simon Cuevas have been downgraded from capital murder to third-degree felony assault. On April 16, 2023, Simon Cuevas was brutally beaten and shot shortly after leaving San Antonio Independent School District’s Brewer Academy. However, as of now, their charges have been reduced to injury to a child with bodily injury.

Local defense attorney Karl Alexander, who is not involved in the case, explained the potential reasons behind this downgrade. “Unfortunately, I don’t have the benefit of viewing all of the evidence in this case,” said Alexander. “There are multiple ways in which this can happen.”

Authorities report that Fernando Flores and Andrew Cantu, both 18 years old, have yet to be sentenced. Meanwhile, two juvenile brothers, aged 14 and 15, were recently sentenced to the Texas Juvenile Justice Department on November 6, 2023, based on their progress and behavior. Tragically, one suspect, Caesar Tijerina, 20, died from a self-inflicted gunshot wound in August.

Alexander highlighted that the initial arrest may have been a rushed decision due to public safety concerns. “There’s a public safety concern; you have to react and make an arrest,” he stated. “As the investigation unfolds, you may realize that perhaps we jumped to a conclusion.”

He also pointed out that flaws in the evidence can hinder the prosecution’s ability to secure a conviction. “If no one talked and they have nothing to demonstrate that everybody knew that gun was there, that’s where you’re going to run into a stumbling block,” he added.

This development has left the community and Simon Cuevas’ family reeling. The emotional weight of the case is palpable, with many expressing disbelief that such serious charges could be reduced so dramatically.
