Homeless Man Waives Hearing in Urgent Upper Darby Bank Robbery Case

UPDATE: A homeless man has just waived his preliminary hearing in a bank robbery case that has captured local attention. Michael McGuigan, aged 49, was arrested for an attempted robbery at the Bank of America in Upper Darby on October 8, 2023, and is now facing serious felony charges.

This urgent development comes as McGuigan was initially scheduled for a hearing on November 6 before Magisterial District Judge Benjamin Johns. Instead, he entered a negotiated waiver on two felony counts of robbery, while a misdemeanor theft charge was withdrawn by Assistant District Attorney Christopher Downey.

According to the affidavit filed by Upper Darby Detective Mazen Malak, police were dispatched to the bank at 10:32 a.m. after reports of an attempted robbery. Witnesses described McGuigan as a white man with blond hair and tattoos, wearing a green shirt and dark green pants. Officers found him standing outside the bank, where he allegedly confessed to the crime.

During the attempted robbery, McGuigan reportedly approached a teller and demanded cash, stating, “Give me the money.” When questioned if this was a robbery, he confirmed, “Yes it is.” The incident has left the community shaken, highlighting ongoing issues surrounding homelessness and crime.

McGuigan remains in custody at the county jail in Concord. His next court appearance is scheduled for December 31, 2023, at the County Courthouse in Media. If no nontrial disposition is reached, the theft charge could be reinstated, further complicating his legal situation.
